City Yacht Club Berth Usage Terms and Conditions
By completing a payment for berth usage on our website, you agree to the following City Yacht Club (Yacht Club) Terms and Conditions. These terms take effect upon confirmation of your online payment.
1. Obligations of the Port Manager (“Manager”)
1.1. The Manager will assign the User a designated berth upon arrival.
1.2. The Manager is not responsible for any User property, including vessels, left at the Yacht Club or its surrounding area.
1.3. The Manager will notify the User, as far as possible, of any conditions that may threaten User property located at or near the berths.
1.4. The Manager issues invoice on request for the full berth usage period.
1.5. Discounts are available only for bookings longer than 3 months and when full prepayment is made within 5 days after order confirmation.
2. User Responsibilities
2.1. Users must park their vessels and vehicles in designated areas without obstructing traffic in the harbor or along the quays.
2.2. Users are responsible for correctly mooring their vessels at the assigned berth. Mooring assistance from staff is available for a fee and must be booked in advance — at least 1 hour before during the day hours, or 2 hours before at night.
2.3. In case of severe weather (wind gusts over 20 m/s, especially from the north/northwest), Users (or their representatives) must:
- Visit the berth;
- Inspect mooring ropes and fender placement;
- Stay onsite during storms when possible;
- Cooperate with port staff and nearby vessel owners to protect and secure vessels.
2.4. Users must coordinate activities at the berth with neighboring vessel owners if their actions may impact the safety or access of other vessels.
2.5. Users are solely responsible for the safety of their vessels and any belongings at the berth or adjacent areas.
2.6. Users must cover all damages caused by their vessel to the Yacht Club’s property or third-party property.
2.7. Vessels must be equipped with appropriate mooring gear: fenders, ropes, electrical/water connectors, and adapters. Anchoring in the Yacht Club basin is prohibited.
2.8. Users are financially liable for environmental damage caused by chemical spills, sewage discharge, or improper waste disposal.
2.9. Commercial activity at the Yacht Berth is not allowed without prior written permission.
2.10. Users may not alter or install any equipment on the berth.
2.11. Vessel repairs may only be performed at the berth with prior approval from the Manager.
3. Discounts
All discounts are granted upon payment and no additional discounts are applied.
4. Penalties and Retention Rights
4.1. Late payments are subject to a penalty of 0.5% of the unpaid amount per day. Penalty fees do not relieve the User of the obligation to pay the principal amount.
4.2. If payment is overdue by more than 15 days, the Manager may retain the User’s vessel (in accordance with applicable civil law) until all outstanding amounts are paid. During retention, short-term berth rates will apply.
5. Term and Termination
5.1. These Terms are valid from the moment of payment confirmation until the end of the selected berth usage period.
5.2. Either party may terminate the agreement with 30 days’ written notice.
5.3. Any remaining obligations must be settled within 5 days after the termination date.
5.4. The Manager may terminate this agreement with written notice if payment is delayed for more than 15 days.
6. General Terms
6.1. The Yacht Berth Internal Rules are displayed near the duty office and are binding for all Users once a vessel is placed at the berth.
6.2. Disputes shall first be resolved through negotiation. If unresolved, they will be settled in accordance with the laws of the Republic of Latvia.
6.3. The Manager is not liable for damages caused by force majeure or other unforeseeable events beyond either party’s control. In such cases, the parties shall agree on compensation for services provided up to the date performance became impossible.
6.4. All notices, including invoices, will be sent to the email addresses provided during booking and are considered delivered on the next business day.
